By accessing or using the services provided by North American Charter Bus (“Company,” “we,” “us,” or “our”), including but not limited to our website, booking platform, transportation services, or any related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not use our Services.
“Agreement” refers to these Terms and Conditions, along with any Order Confirmation, Quote, Invoice, or other documentation provided by the Company.
“Customer” or “You” refers to any individual, group, organization, or entity that reserves, books, or uses our Services.
“Group Leader” refers to the individual designated as the primary contact for a reservation.
“Order Confirmation” refers to the document summarizing the details of your reservation, including but not limited to dates, times, locations, vehicle types, and pricing.
“Vehicle” refers to any bus, coach, shuttle, or other transportation vehicle provided as part of our Services.
3.1 Booking Process
All reservations are subject to vehicle availability. A reservation is not confirmed until you receive a written Order Confirmation from the Company and the required deposit has been processed.
3.2 Deposit and Payment Schedule
a) A non-refundable deposit of 25% of the total reservation cost is required at the time of booking.
b) Full payment is required no later than 30 days prior to the service date.
c) For reservations made within 30 days of the service date, full payment is required at the time of booking.
d) For multi-day trips, additional payment milestones may be required as specified in your Order Confirmation.
3.3 Acceptable Forms of Payment
We accept major credit cards (Visa, MasterCard, American Express, Discover), business checks, and electronic fund transfers. Personal checks are not accepted within 14 days of service. All payments made by means other than wire, ACH or check are subject to a 4% payment administration fee. A fee of $50 will be charged for any returned checks.
3.4 Price Adjustments
a) Prices may be adjusted due to changes in fuel costs, tolls, parking fees, or other expenses beyond our control.
b) Changes to your itinerary, including but not limited to additional hours, mileage, or services, may result in additional charges.
3.5 Gratuity
Gratuity for drivers is not included in the reservation cost unless specifically stated in your Order Confirmation.
4.1 Cancellation by Customer
Cancellation fees are calculated based on the number of days prior to the service date:
a) 60+ days: 25% of total reservation cost (deposit forfeited) b) 30-59 days: 50% of total reservation cost c) 0-29 days: 100% of total reservation cost (no refund)
All cancellations must be submitted in writing to be valid.
4.2 Modifications by Customer
a) Itinerary changes requested more than 14 days prior to service will be accommodated when possible, subject to availability and potential price adjustments.
b) Changes requested within 14 days of service cannot be guaranteed and may incur additional fees.
c) Any reduction in service hours or vehicle size will be subject to the cancellation policy percentages above.
4.3 Cancellation or Modification by Company
a) The Company reserves the right to cancel or modify reservations due to conditions that may jeopardize passenger safety, including but not limited to severe weather, road conditions, civil unrest, or other force majeure events.
b) In the event of mechanical failure or other issues requiring vehicle substitution, the Company will make reasonable efforts to provide a comparable vehicle. If a comparable vehicle is not available, a pro-rated refund may be offered based on the difference in vehicle value.
c) The Company is not liable for delays or cancellations caused by circumstances beyond our control, including but not limited to traffic, construction, weather, or acts of God.
5.1 Itinerary and Schedule
a) The Group Leader must provide a detailed itinerary no later than 14 days prior to the service date.
b) Actual travel times may vary due to traffic, weather, or other conditions beyond our control.
c) Customers are responsible for ensuring the accuracy of all provided addresses and destinations.
5.2 Driver Hours and Regulations
a) All services are provided in compliance with Department of Transportation (DOT) regulations regarding driver hours of service.
b) Drivers may not exceed 10 hours of driving time or 15 hours on duty in a 24-hour period.
c) For trips exceeding these limits, additional drivers will be required at additional cost.
d) Drivers must receive a minimum of 8 consecutive hours off-duty between shifts.
5.3 Vehicle Usage and Restrictions
a) No smoking, vaping, or use of illegal substances is permitted on any Vehicle.
b) Alcoholic beverages may only be consumed by individuals of legal drinking age when permitted by state law and with prior written Company approval.
c) The Company reserves the right to terminate service without refund if passengers engage in illegal activities, become disorderly, or threaten the safety of others.
d) Standing while the Vehicle is in motion is strictly prohibited.
e) Customers are responsible for the behavior of all passengers in their group.
5.4 Luggage and Personal Items
a) Each passenger is allowed one piece of luggage and one personal item, subject to space limitations.
b) The Company is not responsible for lost, damaged, or stolen personal belongings.
c) Prohibited items include weapons, explosive materials, hazardous substances, and any items prohibited by federal, state, or local laws.
5.5 Vehicle Capacity
Vehicle capacity must not exceed the manufacturer’s specified limits. The Company reserves the right to refuse service if the number of passengers exceeds the reserved vehicle’s legal capacity.
6.1 Company Insurance Coverage
The Company maintains insurance coverage as required by federal and state regulations for commercial transportation reservation services..
6.2 Limitation of Liability
a) The Company’s liability shall not exceed the total amount paid for the Services.
b) The Company is not liable for any indirect, consequential, punitive, or incidental damages.
c) Claims for physical damage to luggage or personal property are limited to a maximum of $100 per passenger unless additional coverage is purchased in advance.
6.3 Customer Liability
a) The Customer is responsible for any damage to the Vehicle caused by any passenger in their group.
b) Cleaning fees of $250-$500 will be charged for excessive soiling, spills, or debris requiring special cleaning.
c) Repair costs for damage to the Vehicle will be charged at actual repair cost plus administrative fees.
7.1 ADA Compliance
a) ADA-compliant vehicles are available upon request, subject to availability.
b) Requests for accessible vehicles must be made at the time of booking.
c) Service animals are permitted in accordance with ADA regulations.
7.2 Special Accommodations
Any special accommodations or requirements must be communicated in writing at the time of booking. The Company will make reasonable efforts to accommodate such requests but cannot guarantee all accommodations.
8.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Maryland, without giving effect to any choice of law or conflict of law provisions.
8.2 Dispute Resolution
a) Any dispute arising out of or relating to this Agreement shall first be addressed through good-faith negotiation between the parties.
b) If negotiation fails to resolve the dispute within 30 days, either party may initiate binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
c) The arbitration shall take place in the state of Maryland, and the decision of the arbitrator shall be final and binding on all parties.
d) The prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
8.3 Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permitted by law.
8.4 Entire Agreement
These Terms, along with the Sales Order and/or Invoice, constitute the entire agreement between you and the Company regarding the Services and supersede all prior agreements and understandings, whether written or oral. Signature of the Sales Order and/or Invoice shall constitute acceptance of these Terms herein.
8.5 Amendments
The Company reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our Services after such modifications constitutes your acceptance of the revised Terms.
8.6 Force Majeure
Neither party shall be liable for any failure to perform its obligations under this Agreement if such failure results from circumstances beyond that party’s reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, or government regulations.
8.7 Assignment
You may not assign or transfer this Agreement without the Company’s prior written consent. The Company may assign its rights and obligations under this Agreement without your consent.
8.8 Notices
All notices must be in writing and shall be deemed effective when delivered in person, by email, or by certified mail to the address provided in your reservation.
8.9 Waiver
The failure of either party to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
9.1 Information Collection
The Company collects and processes personal information in accordance with our Privacy Policy, which is incorporated by reference into these Terms.
9.2 Marketing Communications
By using our Services, you agree to receive transactional communications regarding your reservation. You may opt out of promotional communications at any time.
